TERMS AND CONDITIONS:

We reserve the right to change or update our Terms and Conditions and for this reason, we recommend you review and save a copy of the terms each time before you place an order. (Updated June 8th, 2017; 11:01 PST)

Processing & Shipping Policies:

Turnaround Time for Orders: We will do our utmost to process your orders within 3-5 business days+ or less upon receipt of order.  In some cases, processing orders and delivery times may take longer if the item is out of stock or if it is during peak shopping season such as Christmas.

For out of stock items, the turnaround time may depend on our suppliers' stock and delivery times. If it is a handmade item, the artist may require extra lead time to make up your order. In some instances, expect anywhere between 1-2 weeks on top of the regular processing time. We will email you should there be any extra time required above the 3 day turnaround time for processing.

NOTE: +Orders are not processed nor shipped on weekends and Stat. or Bank Holidays.

Shipping rates within Canada are calculated using a flat rate per order. Please see chart below.

*Free shipping applies to single transactions only. Customers cannot combine separate transactions to reach the $75 free shipping mark. For shipments that exceed the weight and size limit of the shipping company, please refer to paragraph below under SHIPPING.

SHIPPING: Goods are shipped via Canada Post, Expedited Service, in almost all cases. Occasionally, a courier service may be used, at our sole discretion. Expect anywhere between 3 - 9 business days shipping time, depending on where you live. Priority (rush) shipping is also available. Please email info@damask.ca for estimates for Priority Shipping when you complete your order.

There may be some instances when the above shipping rates may not apply due to the size or fragility of item to be shipped. In such cases, we will contact you before processing your order.Any goods deemed by the shipping company as over their normal weight or size limit may be subjected to additional shipping charges that the customer will be required to pay. We will inform you before proceeding with the order should there be an extra charge by the shipping company.

SHIPPING ADDRESS INFORMATION:

IMPORTANT: The customer is responsible for inputting the correct shipping address as that address is what we will be printing on the shipping label.  Packages returned to us by Canada Post due to incorrect or incomplete address or information will be subject to a return shipping charge equal to the original full shipping charge. In addition,  a 20% restocking fee and, if reshipping is necessary, the additional shipping charges to complete redelivery even for orders that were originally shipped free of charge.  Sorry, No Exceptions.

We therefore strongly advise that the customer carefully reviews the shipping address information prior to submitting their order. Any errors in shipping address information is the responsibility of the customer. Shipping addresses cannot be changed once an order has been shipped and a shipping confirmation has been emailed to the purchaser. Should goods be shipped to an incorrect address, it is the customer's responsibility to retrieve the items purchased as they will not be subject to replacement. It is important that after a shipping confirmation has been issued with a tracking number for the order, that the customer should follow the progress of their shipment directly with the Carrier, and if necessary, contact them directly to ensure successful delivery.

Note: The customer is responsible for any damages that occurs during transit for returns and will be required to file a claim directly with the carrier for lost or damaged return shipments. 

For shipments to U.S.A. & International destinations: The Damask online store ships mainly within Canada. The automated shipping fees calculated upon checkout of your cart (ie. applicable rates or Free Shipping) applies only to sales within Canada.

As of October 2016, we will be selling and shipping to certain cities in the United States. Note that some restrictions may apply to certain products being shipped to the USA or Internationally. Separate shipping/handling fees will apply to sales outside of Canada. For any sales outside of Canada, please contact us for a shipping quote .We apologize for the inconvenience. Taxes: Our website is set up to tax 12%. If you are out-of-province, you may be charged the tax rate of your home province. Out-Of-Province orders: Once your order has been placed, we will contact you first to confirm the amount of tax that will be charged prior to processing your order as it will be different from what you see at checkout. 

Taxes are not applicable to any sales outside of Canada. However, should there be any applicable duties or taxes from where you are or where the order is being shipped to, the buyer agrees to responsible for those fees.

PRODUCTS SOLD:

NOTE:  Small components could result in serious choking, ingestion and inhalation hazards for children. All items sold and their packaging (eg. plastic bags or any packaging that can fit over a child's head) on this website are Not meant to be toys for children.

Acceptance & Refusals of Orders:

We reserve the right to refuse or deny an order. Reasons for denying orders may include but are not limited to the following:

  • Incorrect credit card information
  • Incorrect billing information (the billing information must match the information that your financial institution has on record)
  • Insufficient information such as leaving certain fields blank such as phone number or email address.
  • Incorrect or insufficient shipping information ( you must give us the complete and correct address as to where to ship; incorrect addresses resulting in packages returned to damask will result in the return charges from Canada Post being charged to the customer. Please refer to the SHIPPING ADDRESS INFORMATION header above for more details).
  • Non deliverable or Invalid email address
  • Suspected fraudulent activity or information

 

Return Policies:

Items in their original condition may be returned within 30 days of purchase for a full refund*, store credit or an exchange. You must return the item to us, undamaged, postmarked within 30 days of the purchase. *Note that the shipping fee is not refundable. Please email info@damask.ca with your transaction number to obtain an authorization number first before returning the merchandise.  Returns without a return authorization number (RA#) will NOT be accepted for a refund.
Please indicate your preference when obtaining your RA # whether the returned item is for a store credit, exchange or refund. The return policy applies to all regular stocked inventory. This policy does not apply to SALE Items (discounted) or Special Ordered Items. We gladly will source and bring in items either not carried or stocked on our website at no extra cost to you but because of this, neither can we accept returns on these specially brought in items. Items normally stocked but quantities ordered exceeding our normal stock levels are also considered to be Special Orders.  Special orders are considered as FINAL sales and are non refundable. Call or email us if you are unsure.

Returns must be in good condition. We cannot accept items opened from original packaging, items that have been resized, damaged, or otherwise altered after delivery. All merchandise must be returned in new, unworn/unused condition, and will undergo quality checks to verify the condition of the returned item(s). All product packaging materials - including boxes, manuals, warranty cards, and any other materials in the original shipment - must be returned with your merchandise. Clothing items that have been used or washed will not be accepted for returns. Items returned more than 30 days past delivery will also not be accepted as returns. Hang tags or barcode stickers must still be attached to the merchandise.

Replacements:

We will replace items only if they are a manufacturer's defect or damaged during transit to the recipient. If the package arrives damaged or ripped, please take a clear, focused picture(s) of it right away before opening the box.

Returning Gift Items:

If you received an item as a gift and wish to return it, we will send you an online credit code equivalent to the price of the item that was purchased from damask.ca, unless the original buyer wishes to receive a refund.

All returns require a 2-3 weeks processing period, after the items arrive in our warehouse. 
Please send your return via an insured courier, with a tracking number as we are not responsible for returned items lost in transit. 

We'll notify you via e-mail when we've processed your refund.

Pre-orders and Cancellations:

Pre-orders may be cancelled until the point where the order reaches production state. We will contact you when your order is about to be made. At that point, payment for the pre-order(s) will be fully processed.   We cannot accept cancellations for any pre-ordered items after this point.  A full refund will be issued only if the supplier cannot fill the order.

Special Orders:

All Special Orders must be prepaid. Special Orders are considered Final Sale Orders. Like pre-orders, a full refund will be issued only if the supplier cannot fill the order. Note that items that are special ordered in for the customer and are over $100, payment method will be either through e-transfer or direct deposit as this is not a regular stocked item and won't be on the website. This applies only to orders within Canada. We do not do special orders outside of Canada.

Prices:

We do our best to keep our store as affordable as possible, but the prices of collectibles and items that may contain precious metals are subject to change without notice.

Canuck Care Package: (applicable only to shipments within Canada)

Canuck Care Package service: Canadians living outside of Canada can purchase gifts to be shipped within Canada, eliminating expensive international shipping fees and duties as well as possible holdups at the border! Gift wrapping service available - email us for details.

Concierge Service:

Can't find what you're looking for? Email us! We'll do our best to help you find it. Many of our collectible items can be special ordered. The same goes for jewellery (we deal with a lot of local artisans) or gifts for your staff, guest speakers, anniversaries, Christmas parties, etc. We can help you customize these gifts to fit whatever event you have so don't hesitate to get in touch. There is no extra charge for the Concierge service.

Payment:

Credit Cards:

We accept VISA and Mastercard. In some cases, we reserve the right to request additional evidence or proof of billing information.

For customers who are within Canada and who are not VISA or Mastercard holders, arrangements can be made for an e-transfer.

Please note we do not accept third party cards.    The card number entered in the payment information must be the card of the purchaser and purchaser must have signing authority for that particular card.The billing information must match the billing address of the credit card used. Billing addresses for card holder MUST be an actual physical address and not a P.O. Box number.

 

Governing Law and Jurisdiction:

The buyer agrees that the terms of this sale and agreement shall be governed by and construed in accordance with the laws of British Columbia and Canada. The buyer acknowledges that the Courts of the Province of British Columbia shall have exclusive and preferential jurisdiction to entertain any complaint, demand, claim or cause of action whatsoever arising out of this sale and agreement. The customer agrees that if he or she commences any such legal proceedings, he or she will only do so in the Province of British Columbia and hereby irrevocably submit to the exclusive jurisdiction of the Courts of British Columbia.

IMPORTANT:

By ticking the box upon check out that says you have read our Terms and Conditions page, you are accepting and agreeing to our Terms and Conditions. By doing so, you are also agreeing to indemnify and hold Damask Designs Inc. (including our and their respective officers, directors, employees, agents) from and against any and all claims, suits, actions, or liabilities for injury or death of any person and harmless from any claim or demand, including legal fees, made by any third party due to or arising out of your breach of this Agreement.
